Client Agreement
Version No. 1, effective as of November 1,
1. Scope of Agreement
www.betolli.com is a website (hereinafter referred to “Site”) where the Client in a simple and convenient way, by using constructor and instructions provided on the site, can design and order a personalized casual shirt.
BETOLLI ensures the content of the site and provides services in accordance with these Terms and Conditions (hereinafter referred to “Rules”). BETOLLI reserves the right to correct, change or update the rules at any time without a prior notice. Any rule changes take effect as soon as they are published. BETOLLI reserves the right to cancel or withdraw any with the terms and conditions granted rights.
Clients’ act of making a personalized shirt order, by using the site, shall be considered as a distance contract. Legal regulation deriving from the European Parliament and Council Directive 97/7/EC of 20 May 1997 on the protection of consumers in respect of distance contracts, the Latvian law “Consumer Protection Act”, the Latvian Cabinet of Ministers “Regulations on distance contracts ” are included in these terms and conditions.
2. Object of the site
The website serves as a platform for communication between BETOLLI and the Clients, a platform for online selling of BETOLLI’s products, as well as a source of information on all matters related to the operation of BETOLLI.
3. User Account, Password and Security
Upon filling out information and completion of the registration process the user account will be created and name and password will be assigned to the Client. The Client is responsible for maintaining the confidentiality of the password and account, and is responsible for all activities that occur under the Client’s password or account. BETOLLI reserves the right to terminate the accounts of user who violates or fails to comply with these rules or who appears to infringe the copyright or other intellectual property rights of others.
4. Ordering, Conclusion of Sales Agreement
The order of product(s) (BETOLLI shirts) chosen by the Client and submitted via the BETTOLI website is a binding offer to enter into a distance contract of baying a shirt that Client has confirmed by clicking on the box “I agree to terms and conditions” and simultaneously confirming that she or he is familiar with and accepts site’s terms and conditions.
The Client must provide the details completely and correctly. The Client takes full responsibility for providing the order details completely and correctly. (including, but not limited to, your personal information, contact information, height parameters)
Upon receipt of the order, BETOLLI will confirm the receipt of the order by sending a separate e-mail to e-mail address provided by the Client.
5. Pricing and Payments
All prices are quoted in Lats (LVL), or Euros (EUR) and include the respective statutory value added tax. For foreign customers (customers whose IP addresses are not Latvian) all prices are presented in euro (EUR).
The shipping costs and, consequently, the total purchase price will be provided to the Client in the final step of ordering procedure.
The Client makes the payment of the order right after the order has been processed and only after the BETOLLI receives the payment, the order will be preceded. BETOLLI have the right without prior notice to unilaterally change the prices of available goods and services.
6. Delivery
The delivery of the BETOLLI products is via Latvian Post or private courier services. The shipping costs and time of delivery depend on the shipping destination and BETOLLI products quantity. The shipping time depends on mail service company, however is approximately 4-5 weeks. Shipping in Latvia takes 3-4 weeks.
7. Warranty
BETOLLI guarantees that the purchased Shirt(s) is produced in good quality, as well as ensure that the Shirt(s) is made of materials appropriate for reasonably expected purpose of the shirt.
BETOLLI warranty does not apply for the damages caused or resulted to the purchased product(s) due to improper transportation.
Minor variations in color and decorations of the purchased Shirt(s) are not considered as bad quality of the purchased product. Differences in colors or tone may occur due different color reproductions in the computer monitors.
8. Privacy Policy
BETOLLI takes all necessary action in order the personal data processing occurs in compliance with the European Parliament and Council Directive 95/46/EC on the protection of personal data and on the free movement of goods and Latvian law “Personal Data Protection Act”.
BETOLLI undertakes to obtain and maintain only such Personal Data that is relevant to or required for the conduct of BETOLLI business activities. The clients’ Personal Data collected on client will be processed by BETOLLI in order to process orders; to support BETOLLI to improve the Site and client’s online experience; to provide the client with information about BETOLLI products and services; for ordering, customer support, payment, processing and service purposes; and as otherwise allowed by law.
BETOLLI obtains and uses the Client’s personal information to the extent necessary for the Client in order to ensure the best possible level of service. Client’s personal information helps BETOLLO to inform the Client about new products and services, including special offers and/or about the Site features and changes that might be of interest for the client.
Acceptance of payment cards in cooperation with First Data Latvia and Swedbank, according to the International Card Organization rules and the PCI DSS standard (PCI Data Security Standard) (www.pcisecuritystandards.org). First Data Latvia developed solution for servicing card transactions on the Internet. This solution is fully consistent with the international payment organizations VISA and MasterCard security requirements and specifications and is certified in both organizations.
9. Rights of Withdrawal
Client’s purchased Shirt(s) is made after Client’s specifications or is clearly personalized; thus the Client can not exercise the right of withdrawal.
10. Dispute settlement
In the event of any dispute, claim, or disagreement arising out of or relating to ordering the Shirt(s), using the Site, fulfillment of the order are resolved through mutual negotiations.
If a dispute, claim, or disagreement has not been settled through peaceful negotiations, disputes, claims, or disagreements are dealt with in court of Latvian Republic in accordance with Latvian law.
11. Consent to receive notifications by e-mail
Agreeing to the terms and conditions, the Client consent to receive BETOLLI notices, agreements, order updates and other information (“notifications”) to the Client’s provided e-mail address. The Client agrees that notifications sent to her/his e-mail address meet the terms and conditions applicable to such communication in writing.
This provision does not apply to optional marketing information, which the Client can choose to receive at her/his preference.
